This Privacy Policy is designed to help you understand how the owner of the Discus Awards website ("Discus") collects and use the personal information you decide to provide via the website located at www.discusawards.com (the "Site").

This Privacy Policy is part of the binding contract formed between you and Discus under the DiscusAwards.com Terms of Use and User Agreement (the "Agreement").

You should read this Privacy Policy and the Agreement carefully. By using or accessing the Site, you are accepting the terms of and practices described in the Agreement, including this Privacy Policy.

The Information Discus Collects

"Personal Information" means (i) information about a User provided to Discus by a Visitor who is nominating someone for a Discus Award or by a Member as part of completing the nomination process and registering on the Site; and/or (ii) personal information you place, post, or make on the Site about yourself. The terms "User," "Member" and "Visitor" have the meanings set forth in the Agreement.

"Personal Information" includes all information about a person, including but not limited to name, email address, telephone number, physical address, gender, school, photographs or other images, academic history, extracurricular activity and any other personally identifiable or biographical information.

When you use the Site, you may provide us with Personal Information you knowingly choose to disclose.

If you nominate a third party for a Discus Award, you will provide Discus with Personal Information of the nominee (including name and email address) that will enable Discus to email the nominee and invite the nominee to confirm his or her desire to be a Discus Award nominee. The Site stores the nominee's invite-related Personal Information for 30 days. Discus will delete the nominee's Personal Information if, after 30 days, the nominee has not confirmed his or her desire to be a Discus Award nominee by registering on the Site and completing the nomination process. The link in the email provided to nominees who have been nominated by other people will be disabled after 30 days.

Discus will not disclose or sell Personal Information of a Discus Award nominee until the nominee has confirmed his or her desire to be a Discus Award nominee by registering on the Site and completing the nomination process.

You may provide Personal Information of a third-party you designate as a reference for your nomination for a Discus Award. Discus will use such Personal Information only to communicate with your third-party references for purposes of validating your nomination.

By using the Site, you are consenting to have your personal data transferred to and processed in the United States.

Use of Personal Information Obtained by Discus

Discus will use your Personal Information (including your name and email address) to inform you of offers and services we think would be enjoyable or valuable to you. You may opt out of such emails, but Discus reserves the right to send you notices about your account even if you opt out of all voluntary email notifications.

Discus may also use your Personal Information to provide information or services to you, to answer your questions and to communicate with you about a nomination for a Discus Award or winning a Discus Award.

Unless you opt out of such display at the time of confirming your nomination, Discus will display your Personal Information (including your name and photo) on the Site if you win a Discus Award.

Discus's Use of Personal Information of Discus Award Winners

Discus will attempt to verify the identity of each Discus Award winner and confirm that the nominee wants to accept the Discus Award. If you accept a Discus Award and you do not opt out of such display at the time of confirming your nomination, your Personal Information (including your name and photo) will be displayed to the public on the Site.

"Public Profile" means the Personal Information of a Discus Award winner that is displayed publicly on the Site.

Discus will make the Public Profile of each Discus Award winner available to be viewed by the public and shown in search results conducted by the public on the Site.

Discus Award winners will have the opportunity to opt out of having their Public Profile displayed on the site and viewable and searchable by the Public. However, such an opt-out designation will not remove the Personal Information from the Site or affect the Discus Award winner's status as a Member of the Site. The Discus Award winner's Personal Information will still be on the Site in non-public environments and used by Discus under the terms of this Privacy Policy unless and until the Discus Award Winner's Membership on the Site is terminated.

Sharing Your Information with Third Parties

In all cases discussed in this section in which Discus may disclose your Personal Information to third parties, Discus may do so by selling your Personal Information, renting your Personal Information or otherwise exchanging your Personal Information for value and consideration.

Discus may disclose your Personal Information (without identifying who you are) to third parties. One purpose for doing so is to personalize advertisements and promotions of Discus or third-party partners of Discus.

Discus will disclose certain Personal Information to the panel of judges who evaluate Discus Award nominees and determine who wins a Discus Award. Such Personal Information shall NOT include contact information (email address, mailing address) for a Discus Award nominee.

Discus may disclose your Personal Information to third-party colleges, universities and other higher education providers to be used in their outreach and recruitment efforts.

Discus may provide your Personal Information (including your email address and other contact information) to third-party marketers and service providers. Discus does this when we believe such sharing is reasonably necessary to offer Discus's services; legally required; or permitted by you. Specifically, Discus may use third parties to facilitate its business, including hosting the Site at a co-location facility, sending email updates about the Site or to process payments for products or services. In these instances, our third-party service providers may have access to your Personal Information. When Discus provides your Personal Information to third-party service providers, we implement reasonable contractual and technical protections limiting the use of that Information for the specified purposes.

Discus may supply your Personal Information to data aggregators and marketers for the purpose of sending email or otherwise communicating with you.

Discus may be required to disclose Personal Information to a third party in response to lawful requests (such as subpoenas or court orders) or in compliance with laws or regulations. Additionally, Discus may share your Personal Information with a third party when Discus believes it is necessary to comply with law, to protect Discus's property, to prevent fraud or other illegal activity. This may include sharing information with other companies, lawyers, law enforcement officials and other government agencies.

Discus may provide services jointly with other companies on the Site. Discus may share your Personal Information with such companies in connection with the services.

If the ownership of Discus or all or substantially all of Discus's business changes hands (by sale, merger or otherwise), your Personal Information may be transferred to the third-party acquirer

In the event Discus becomes the subject of a bankruptcy proceeding, whether voluntary or involuntary, Discus, or our trustee in bankruptcy, may sell, license or otherwise dispose of your Personal Information in a transaction approved by the bankruptcy court.

Opting In and Opting Out

Discus may use check boxes (or comparable means) to confirm your consent to receive special offers and/or other information from Discus and other third-party partners of Discus. By checking such boxes or leaving a box checked, you are choosing to receive commercial communications from Discus and third-party partners of Discus, and you will be consenting to Discus providing your Personal Information to those third parties, and you may receive information and offers from Discus and third-party partners of Discus by e-mail, U.S. mail or other means.

Discus may use check boxes (or comparable means) to confirm your consent to have your Personal Information disclosed to a third party for the purpose of having your Personal Information appear on the third party's website (by way of example, in the same way that you might consent to have your photos on Flickr appear on your page on Facebook). By checking such boxes or leaving a box checked, you will be consenting to Discus providing your Personal Information to those third parties, and your Personal Information may appear on the third parties' websites.

You may opt out of receiving future commercial communications from Discus or third parties either (i) by modifying or deleting the your Personal Information on your user account page the Site; (ii) by following the instructions located at the bottom of an e-mail, (iii) by sending a request to us by email to info discusawards com, or (iv) by sending us a request by mail to Campus Direct, Inc., Attention: Discus Awards Service, 4733 Elm Street #300, Bethesda, MD 20814.

Please note that opting out using these means will not affect your previous consent to receive communications from Discus's third-party partners or to have your Personal Information disclosed to a third party for the purpose of displaying your Personal Information on their websites.

Discus cannot control the actions of its third-party partners, which operate independently of Discus.

The Site may contain links to other websites. Discus is not responsible for the privacy practices of other web sites. We encourage you to be aware when you leave the Site to read the privacy statements of any linked websites that you visit. This Privacy Policy applies solely to information collected by Discus on the Site.

Changing or Removing Information

All uses and disclosures of your Personal Information discussed in this Privacy Policy will continue unless and until you access your user account page on the Site and:

(i) modify the Information (in which case, the modified Information will be used and disclosed);

(ii) delete the Information (in which case the remaining Information will continue to be used and disclosed); or

(iii) terminate your status as a Member on the Site, which you can do on your user account page on the Site (in which case, Discus will promptly discontinue the use and disclosure of your Personal Information).

Access and control over your Personal Information on the Site is readily available through your user account page on the Site. You may modify any of your Personal Information on your user account page. You may also terminate your Membership on the Site on your user account page, and we will remove your Personal Information from the Site and our servers. Deleted Personal Information may remain in backup copies for a reasonable period of time but will not be generally available on the Site.

Gathering Aggregate Data and Cookies

Discus routinely gathers information about the use of the Site by all users collectively. Discus's server logs provide us with information such as what pages are being visited most, what domains our visitors are coming from, when our Site is busiest, and what websites are referring users to us. This information helps us to improve our services and to evaluate our marketing efforts. We typically use such data anonymously and aggregately, and this information may be shared with third parties in the aggregate.

When you access and use the Site, Discus collects technical information, including your browser type and IP address. In addition, we store certain information from your browser using "cookies" to remember usernames and passwords for tracking click streams and informing the web server that you have returned to a specific page. Cookies are pieces of data normally stored by your browser. Cookies cannot obtain Personal Information. One of the primary purposes of cookies is to provide a convenience feature to save time. Because of cookies, Discus can deliver faster and more accurate results and a more personalized Site experience. However, you can remove, disable or block the Site's cookies using the security or option settings in your browser.

Third Party Advertising

Advertisements that appear on the Site are sometimes delivered (or "served") directly to users by third party advertisers. Such advertisers may automatically receive your IP address, and they may download cookies to your computer or use other technologies such as JavaScript and "web beacons" to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertisers to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. Discus does not have access to or control of the cookies that may be placed on the Site by the third-party advertisers. Third-party advertisers have no access to your Personal Information unless you choose to share it with them.

Security

Discus takes appropriate precautions to protect your Personal Information. Your Personal Information is located on a secured server behind a firewall. When you enter certain sensitive information (such as credit card number or your password), we (or in the case of credit card information, our data-secure e-commerce partner) encrypt that information using secure socket layer technology (SSL). Please be aware that email is not recognized as a secure communication. Discus requests that you not send sensitive private information to us by email.

Discus is not responsible for circumvention of any privacy settings or security measures contained on the Site.

Notices and Revisions

Discus reserves the right to change this Privacy Policy at any time. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on the Site. If Discus modifies the Privacy Policy, we will post the modifications and will indicate the Policy's new effective date on the top of the page.

At Discus's discretion, Discus may notify you of changes to the Privacy Policy by email, or with notice on our home page. Discus encourages you to review this Privacy Policy on an ongoing basis so that remain aware of the current Policy.

Children Under Age 13

Discus does not knowingly collect or solicit Personal Information from anyone under the age of 13 or knowingly allow such persons to use the Site or register on the Site. If you are under 13, please do not use the Site or attempt to register on the Site or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any Personal Information to or on the Site. If Discus learns that we have Personal Information of a child under age 13, we will delete that information as quickly as possible. Children Between the Ages of 13 and 18

Discus recommends that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the Internet.
